SPECIAL MEETING

Monday, June 6, 2005 at 7:00 p.m.

MINUTES

Chairman Richard Harris called the meeting to order at 7:02 p.m.  Present were Supervisor Arland Schantz and Township Manager Ellen Koplin and approximately 10 others. 

Harris stated the Township recognizes the court order entered last week vacating Denise Holub’s appointment and reinstating Lois Gadek’s appointment to the Planning Commission to

December 31, 2007.

MOTION was made by to appoint Denise Holub to fulfill position vacated by the resignation of Susan Ritter, with term expiring on December 31, 2006.                       Unanimous

            Harris stated the terms of Planning Commission Members as follows:

                        Robert Gehman             December 31, 2005

                        Denise Holub                December 31, 2006

                        Eileen Howatt               December 31, 2006

                        Mark Jamison               December 31, 2005

                        Ann Frey                      December 31, 2007

                        Lois Gadek                   December 31, 2007

                        Theodore Zapach          December 31, 2008

Citizen Comments:

            Why is Lois Gadek being reinstated? 

Harris replied, the outgoing Board of Supervisors appointed new members in December of 2003.  The new Board of Supervisors nullified the appointments and appointed two new members at the January 2004 Reorganization Meeting.  Gadek filed an action against the Township and the court decided in her favor. 

            What did it cost the township?

            Harris asked Koplin to check on that.

What if business conducted by the Planning Commission could be challenged if votes were taken by non-valid members?

Harris replied, we will address that if something arises.

Harris adjourned the meeting at 7:09 pm.
