LOWER MILFORD TOWNSHIP of LEHIGH COUNTY BOARD OF SUPERVISORS Thursday, May 17, 2007 at 7:30 p.m. MINUTES
Chairman Richard Harris called the meeting to order at 7:31 p.m. Present were Supervisors Arland Schantz and Donna Wright. Also present were Township Solicitor Emil Kantra, Township Manager Ellen Koplin; Public Works Director Richard Kinsey and approximately 17 others.
The Pledge of Allegiance was said by all.
Citizen comments were accepted throughout the meeting.
Regular Business: MOTION was made by Schantz to approve the minutes of the April 19, 2007 Board of Supervisors Meeting, with the understanding the portion on page 3 - Citizens Comments made by Lois Gadek would be transcribed, and also the May 9, 2007 Workshop. Wright seconded the motion. Unanimous
MOTION was made by Wright to accept the Treasurers Report as of April 30, 2007 as follows: · General Fund $561,804.00 · Capital Reserve Fund 63,765.00 · Road Projects Fund 288,146.00 · State Liquid Fuels Tax Account 172,649.00 · Developer Escrows 94,153.00 (Non Twp. Funds) Schantz seconded the motion. Unanimous
MOTION was made Wright by to pay the May bills. Schantz seconded the motion. Unanimous
Police Business: The Police Reports were made available to the public. Schantz asked about the status of hiring a second police officer. A letter from Chief Dondero stated he would like to discuss that possibility with the Supervisors. Harris stated that discussion will take place.
Public Works Business: The Public Works Report was made available to the public.
Zoning Business: The Zoning Report was made available to the public.
Manager’s Business: Manager’s report was made available to the public.
Subdivisions/Land Developments: MOTION was made by Schantz to accept the Jennifer Johnson Subdivision upon recommendation of the Planning Commission and Township Engineer and subject to Attorney Kantra’s letter of May 9, 2007. Wright seconded the motion. Unanimous
Fire Co. Report: Volunteers are needed for dinners and especially for the Carnival in July. There will be no more dinners after the Pork and Kraut dinner in June for the summer.
Old Business: MOTION was made by Wright to accept the Crack Seal Contract with Bothar Construction at $10.58/gal applied. Schantz seconded the motion. Unanimous
MOTION was made by Wright to accept the Seal Coat Contract with Asphalt Maintenance at $.91/sq. yd. applied. Schantz seconded the motion. Unanimous
MOTION was made by Schantz to accept the contract with Eastern Industries for the following aggregates: #67 Type A Aggregate 2RC Aggregate #8 Aggregate 1.0% loss by wash PA-2A #3 Aggregate #1 Aggregate R-4 Rock Lining R-5 Rock Lining R-6 Rock Lining R-7 Rock Lining 700 Type 2 Anti-skid Wright seconded the motion. Unanimous
MOTION was made by Schantz to accept the contract with Naceville Materials for the following aggregates: #10 Aggregate #57 Aggregate Wright seconded the motion. Unanimous
Harris opened bids received for sale of the 1979 R-Model Mack Truck (see attached).
MOTION was made by Schantz to award the 1979 R-Model Mack Truck to high bidder Richard M. Schwarz for $6,611. Wright seconded the motion. Unanimous
MOTION was made by Wright to pass Resolution 2007-21 accepting the property of James & Christine Pearre into the Lower Milford Agricultural Security Area upon the recommendation of the Planning Commission and Ag Advisory Board. Schantz seconded the motion. Unanimous
MOTION was made by Wright to adopt the Ordinance for East Mill Hill Road T-381 Vehicle Restriction. Schantz seconded the motion. Schantz stated claims of exemption to the ordinance will be subject to the discretion of the local authority using the ordinance for interpretation. Unanimous Kinsey stated the signs for this are in stock. If not, then will be here within a week.
Schantz brought up the fact that a Bio-fuels expert lives within the township. He stated the fuel is available through our suppliers. This expert suggested up to 5% additive to our diesel fuel to give us a price differential. Kinsey stated the home heating oil we get is already Bio-Diesel, but Bio-Diesel fuel for the trucks
is not yet available for our on road vehicles.

Citizen Comments: Jean Schoch asked about a hearing scheduled that she did not see an ad for. Attorney Kantra explained it is an argument for the Procedural Challenge which is a continuance and does not need to be advertised. Schoch was concerned about the opening of mail sent to the township address in her name. It was explained that since it was address to the township address it was handled as township mail is generally handled and opened. A discussion ensued in which Atty. Kantra explained that mail must be opened in a timely fashion since dates and deadlines the township must meet could be involved. A Schantz said he has arranged to open all of his own mail, not the Township staff. Chairman Harris said he has no problem with the staff opening his mail, since the mail involves township business and not anything that the staff couldn’t see. E. Koplin said that mail containing “personal and confidential” would not be opened because it could contain sensitive information or involve litigation. Harris said that if some people are concerned about their township mail being opened by the township, it should be sent to their residences.
