LOWER MILFORD TOWNSHIP of LEHIGH COUNTY BOARD OF SUPERVISORS Thursday, April 19, 2007 at 7:30 p.m. MINUTES
The meeting was conducted by Vice-Chairman Arland Schantz who called the meeting to order at 7:31 p.m. Present was Supervisor Donna Wright. Also present were Township Solicitor Emil Kantra, Township Manager Ellen Koplin, Public Works Director Richard Kinsey and approximately 24 others.
Schantz announced the absence of Chairman Richard Harris.
The Pledge of Allegiance was said by all.
Citizen comments were accepted throughout the meeting.
Regular Business: MOTION was made by Wright to approve the minutes of the March 15, 2007 Regular Meeting and the April 11, 2007 Workshop Meeting. Schantz seconded the motion. Unanimous
MOTION was made by Schantz to accept the Treasurers Report as of May 31, 2007 as follows: · General Fund $565,792.00 · Capital Reserve Fund 63,482.00 · Road Projects Fund 286,868.00 · State Liquid Fuels Tax Account 41,539.00 · Developer Escrows 222,244.00 (Non Twp. Funds) Wright seconded the motion. Unanimous
MOTION was made by Wright to pay the April bills. Schantz seconded the motion. Unanimous
Police Business: The Police Report was made available to the public.
Public Works Business: The Public Works Report was made available to the public.
Zoning Business: The Zoning Report was made available to the public.
Manager’s Business: Manager’s report was made available to the public.
Subdivisions/Land Developments: Schantz announced the receipt of the Fadil Lot Line Change Application.
MOTION was made by Wright to approve the Haines Lot Line Change Plan. Schantz seconded the motion. Unanimous
Fire Company Report: There were copies of a written report from the Fire Company on the back table for the public.
Old Business: The sealed Road Material Bids and In-Place Bids were opened (see attachment).
There were no sealed bids received for the sale of 1979 R-Model Mack Truck.
MOTION was made by Schantz to re-bid the truck with a minimum bid of $6,000. Wright seconded the motion. Unanimous
MOTION was made by Wright to adopt Resolution 2007-20 for Support of Regionalization of Southern Lehigh EMS. Schantz seconded the motion. Unanimous
MOTION was made by Wright to adopt the Ordinance Revising Act 167 Stormwater Management for Saucon Creek. Schantz seconded the motion. Unanimous
Attorney Kantra stated the Board of Supervisors could add Section 4902 of Title 75 of the Vehicle Code to the draft Ordinance for East Mill Hill Road Vehicle Restriction. This “local delivery” exemption would give authorities the ability to discern the purpose of a vehicle going over the level of restriction, and if that purpose is a valid exemption.
MOTION was made by Wright to advertise the draft Ordinance for East Mill Hill Road Vehicle Restriction with the addition of Section 4902, Title 75 of the Vehicle Code. Schantz seconded the motion. In response to questions by Don Weinberger of the Lower Milford Residents Association, Attorney Kantra explained how the courts would define the term “local delivery”. He also explained the fines are limited to what is in the State Statute at $50 to $100. Weiberger stated he applauds the Supervisors for adopting this vehicle restriction but thinks the fines are inadequate. Wright suggested he contact Representative Karen Beyer. Unanimous
New Business: Wright announced the receipt of the receipt of the draft Lehigh Valley Greenways Plan from LVPC. A copy is available at the township for public viewing. Comments by the Planning Commission need to be submitted to the Lehigh Valley Planning Commission by May 10, 2007 via Planning Commission Chairman Michael Snovitch.
Schantz announced the receipt of the Agricultural Security Area Application for William S. Urmy and Ralph B. Urmy, 53.18 Acres located on Passer Road in Upper Saucon Township.

Citizen Comments: Police Chief John Dondero commented concerning the East Mill Hill Road vehicle restriction and the fines that would be imposed. He stated the fines noted in the State Statute do not include an additional $75 fee.
Don Weinberger announced there is a booklet on the back table containing information on stream designations and the effects.
Timothy Docherty asked if the Township could be a drop-off site for Cell Phones for Soldiers. Schantz stated it would be looked into.
